Off-Roaders Win Lawsuit to Close OHV Park

OFF-ROADERS WIN AGAINST LAWSUIT TO CLOSE BAY AREA OHV PARK

OAKLAND, CA --The BlueRibbon Coalition (BRC), a national trail-based recreation group, wants to congratulate the California OHV Program in a recent court victory to keep a popular state managed motorized park open in the S.F. Bay Area. The suit was dismissed "with prejudice" under a recent stipulation, meaning that it cannot be re-filed.

Late in 2009, two anti-OHV groups filed an action against California State Parks and the Off-Highway Motor Vehicle Recreation Division, alleging violations of state laws regarding water pollution at Carnegie State Vehicular Recreation Area. The California Sportfishing Protection Alliance and Public Employees for Environmental Responsibility filed the suit in the Superior Court in Alameda County alleging violations of state laws regarding water pollution at the park. 

The anti-access groups won an initial round in the Superior Court, but that decision was reversed on appeal.  In the meantime, the agencies have worked diligently to address water quality to the apparent satisfaction of the anti-access groups. The stipulation resolving the case makes clear it is not to be construed for any purpose as an admission of liability.

Don Amador, Western Representative for the BlueRibbon Coalition, stated, "I want to thank the hard working staff at the Division and the thousands of users who fought back against this unwarranted lawsuit. This whole case could have been avoided if tshe anti-OHV groups had offered to work with the park in a cooperative manner instead of filing a lawsuit to close the park down."

"The park and Central Valley Water Board are to be commended for their patience and professionalism under difficult circumstances, and they set an example of how agencies can work together to address environmental issues without resorting to litigation," Amador concluded.

This is a place where I taught my kids how to ride. I've raced motocross & hare scrambles here. The SF bay area needed this.. Great work Blue Ribbon Coalition ! Everybody that ride a dirt bike Should join the Coalition. I've been riding since the 60's and I've seen so many places close... JOIN !

In New England, the environuts have pretty much won. There are very few places to ride legally anymore. Of course, the morons on the riding around the lakes and down the roads probably had something to do with it.

I ride there all the time. The anti- ohm where complaining about bad water in the river, which flows like 2 weeks out of the year. Otherwise it is flat. The govt chose to test bombs in the same area. How can you determine bad water is related to dirt bikes when bombs are going off in the same place. The bay area is huge and there are only 3 small portions of land here that are a microscopic fraction of land set a side for riding. But people still want to complain and shit it down. Glad they won

Excellent news! It's amazing that they even tried to shut it down. The bad water issue is a joke for reasons dave1112 wrote and the place is in the middle of nowhere - check it out on google earth... One thing that does not help our cause, though are a** holes who trash our riding areas. I was recently in Forrest Hill in Northern Cal and the place is beautiful with amazing riding. Some dipsh!t(s) had camped in a couple of areas and trashed the hell out of the place. Garbage and shotgun shells everywhere. What the F were they thinking! I was so pissed to see it! I called the ranger and volunteered to clean the place up. Come on people are you that inconsiderate and pathetically stupid?!!!

And its one of only two places around to free ride in the Bay Area, with millions of people, and they want to shut places down.

Humans need recreation, we need activity, nature, sport... if not we will go crazy. Please politicians realize this basic human need and keep these places open, give the funding, it's for the health of everyone.

I live here in Heber City UT and between riding in the AWESOME OHV parks we here and in the mountains, we are so lucky! Over Memorial Day we went down to S.UT to do some quad riding in the mountains and camp.

I was so freakin pissed to see how some pathetic, whitetrash, low-life human beings could leave all the garbage they leave at their camp sites:

Crushed beer cans in the fire pits - aluminum don't burn dick heads
Shattered Beer bottles at the fire pits - unless you plan on blowing glass, blow something else!
Shotguns shell cases - really, pick it up.............

I personally would like to hunt tree huggers, but we need to speak up when dirt bags ruin it for the rest of us.

Next time the Coalition or AMA is asking for your help to fight against these wackos, do it. We can't let them win. Otherwise we'll end up like Europe.

Sure is funny how these environmental groups want us out of the open land, but when it comes to building wind farms or solar farms, suddenly the impact is not considered.
