I hope they prosecute Stewart to the fullest extent of the law. What he did was stupid and could have gotten someone hurt. What if the person he was flashing was a wanted felon and decided he wasn't going to be pulled over? Less serious, what if that was your girlfriend or wife and they got seriously freaked out over someone impersonating a cop? Women have been raped and murdered under that same scenario. I'm sure Stewart and pal were just having fun, but it could have turned out bad.

Doesn't make sense, how could he pull up behind and on the side at the same time. I think he was just trying to speed around town and got caught. Not really anything close to impersonating a cop. I'm sure being showed up outraged the off duty policemen. How many times have you been stuck in traffic and wished everyone would move out of the way. Unfortunately James didn't realize flashing lights are a felony. Seems like a honest mistake to me. County employees have emergency lights and so do on-call DR.s, i used to mess around with a Key chain and a PA and do the same stuff.. James did not get to have a childhood. 266jking, only law enforcement is allowed to have red and blue lights. All other emergency services/ other vehicles with lights are a sold color (some fire/ems are two colors but not blue/red). There is nothing in most states laws that allow DR's to run "code" and use lights (that would be a Felony).

Below is the state law that says you cant do the light thing, doesn't say its a felony even if you read all the way through it. So unless the driver or passenger says they were a cop, which it doesn't sound like they did. Its gonne be pretty hard to take this to court as a Felony.

Florida Laws: FL Statutes - Title XXIII Motor Vehicles Section 316.001 Short title.

316.2397 Certain lights prohibited; exceptions.
(1) No person shall drive or move or cause to be moved any vehicle or equipment upon any highway within this state with any lamp or device thereon showing or displaying a red or blue light visible from directly in front thereof except for certain vehicles hereinafter provided.
..........lists all color who and when........
(10) A violation of this section is a noncriminal traffic infraction, punishable as a nonmoving violation as provided in chapter 318.


looked up 318, not seeing where red and blue make a felony.

Not a JS fan here, but this has been blown way out of proportion by some off duty cops.

Just a little more information on this for those not familiar with the road James was on (SR 417). Its a toll road (ie an interstate). So to think that he was just using the lights to get around traffic and through stop lights is just not accurate.

One of the reports says that after he turned on the lights and the car pulled to the shoulder Stewart rolled up alongside, lowered the passenger window on his truck and hollered at "Slow it down you guys!" and kept on rolling. In other words he had no intentions of actually stopping the other car or having any kind of an interaction other than a prank.
Stupid, but if intention counts- and it should- he will be severely reprimanded but not severely punished.
It appears to have been intended to be a victimless prank, and that explains a lot.

We all know that James was just having fun, and was not going to hurt anyone... but the reality is that people do use this ruse to rape, murder and steal from others all the time. a) This was a felony.

b) The state has confiscated Stewart's truck (forfeiture seizure because it was used in the commission of a felony.)

I used to work with ignorant cops everyday. They would always be going somewhere (lunch,donuts, court, whatever) they would constantly speed and weave in and out of traffic just because they were cops they think they are above the law. Point is they also do it in theyre own cars also, all they do when they get pulled over is flash theyre badge for a courtesy pass. This is probably what they were doin. So don't worry,,,your safe, I will still treat you and your family with dignity and respect, no matter how much you hate us! As far as Cops thinking everyone is guilty, that is not true. Cops develop probable cause, PERIOD! Its up to the courts to determine guilt,,not the cops.
James may have been playing a prank. The off duty cops may have been speeding. It will all come out in court,,,that's what our system is designed for. I really don't think anyone should be bashing, until they know the details.

Once, i was driving away from work on my lunch break, and a dark blue dodge intrepid started following me, like he was pissed off, so i sped away and tried to lose him, i thought he was a psychotic road rager and wanted to fight me. HE was a fucxing cop in an unmarked car. He did not give me a ticket (i rolled a stop sign at 2 mph earlier) but he was very angry and yelling at me, like he was going to send me to the slammer. Some cops really ARE dildoooo's, it is very TRUE.

Cutshall, how do you determine if you're being pulled over by a "real" cop? The only way to do that is to make note of the color of the lights. ONLY police officers have such lights, red and blue. In CT there are state cops in blacked out Chargers, Camaros, Mustangs, Explorers, and Yukons with red and blue lights in the grill and on the dash. No other markings. On a dark highway at night are you or your daughter NOT going to pull over for red/blue flashing lights? The cops pulled over thinking James "might" have been an official vehicle, so how does your daughter know how to tell? Hope she never gets pulled over by an undercover car and decides wrong.

U got to make some simple guidelines man... Over here in Holland... Unmarked police cars who CAN stop other vehicles.. The cars are manned with at least 2 police officers in uniforms. Now if they do not wear a uniform... They can NOT stop a car.. And have to call for backup. Simple? Unless they are pursuing a suspect.. Then those rules do not apply.. However they still call for backup to assist when possible.
But again... Cops over here or in europe are not as trigger happy as the ones in the US.. And even though a simple high school diploma suffices to be a cop (At least over here)... Give credit to those guys (cops)... They try to serve and protect against a shitty pay.
Well.. Yamaha is in a dilema.. They have no other rider capable of winning.. Milsaps is a utter waste of space on the track who gets millions to finish 10th or worse... Brayton is still too unproven and relatively old for motocrosser... Sipes is old and is still in the 250 class... Regal is Regal... And no other rider seems to be fond of the latest yamaha yz...

Everyone - I have THEE scoop here. This is the way it went down according to the OPD.

The sedan pulled out in front of James from a side road, after speeding around a corner.

James may have seen this as other "kids" driving fast and decided to "teach" them a lesson. But that is speculation at this point.

James rolled up behind the car and started following closely. He then backed off and flipped on a red/blue flashing light that was affixed to his dash. The driver of the car, did not pull over right away. Stewart kept the lights on for long period, still following.

After some time (about 30 seconds) the driver of the car finally pulled to the shoulder, thinking that perhaps it was a fellow cop that knew him or one of the other officers in the car. They were highly suspicious because no one in the car recognized the vehicle.

Stewart pulled over to the shoulder behind the car with his lights still on.

Then, Stewart pulled up next to the car quickly, at which time the passenger in his truck rolled down the window and yelled "something about slowing down".

The officer driving the car, had pulled his badge and police ID.

At this time, the officer intended to ask for ID but Stewart sped away.

The officers followed the truck, and dialed 911 - a seven minutes 911 call is on record.

Stewart admitted to "just having fun" but the police were having nothing of that.

According to Florida law - you are supposed to stop when an officer identifies himself and asks for ID. Stewart did not, so they nailed him with felony evasion.

It is also against Florida law to have red/blue combo lights in any vehicle unless operated by a sworn law officer.

I'm a Stewart fan, but this was just a stupid stupid thing to do. Two years ago in Orlando a woman was abducted and raped by a man in a "dark colored pickup truck" posing as a cop with flashing lights. The women got away by the the cops never found the truck or the driver. The cops don't suspect James of anything of the sort, but pulling a stunt like this, is NOT going to sit well with the police or judges.

The fact that James is a celebrity (of sorts) will probably keep him out of jail. Because I'm sure the judge will see community service as a better way to help others not make the same mistake.

I don't think that the police are bragging about this arrest, and it would not have made such headlines if there was no chase to the airport. All I have to say is that this supports my Bubba is not a good role model for kids. Probably some how this is CR's fault and if he wins the championship it won't be "straight up" anyone who prevails over JS will never get the credit due to them because for some reason JS is thought of as some super hero. He obviously is not a super hero just another person that can lose and get caught. Money prevails in the court system and JS will do the minimum sentence possible for his crime.

I bet JS won’t miss a race. It’s hardly as detrimental to society as some have trumped it up to be. There was zero kidnapping and zero displays of violence. If you listen to the audio of the 911 call it definitely sounds like they were just goofing around and hit the lights behind the wrong vehicle. This is not really realted to the AMA.....Did the AMA get involved when past riders got popped for drugs or when Pastrana almost killed his buddy. If it happened at an AMA event, then they could do something......They may tell James, dont pull that crap here....but the AMA banning James or taking any action is highly unlikely....not their jurisdiction so to speak.

We dont know all the specific details....if the lights were not James and the idea was his 44 year old buddies, then James could be an accomplice ....I dont know how they would be able to identify the off duty cops ID from way up in the air of james' truck...if they even saw it at all....so they may not knwo they were cops...the off duty cops didnt say anything, just pulled out and ID, which could have been fake too....Bad idea, bad situation, but it was all just a joke that went bad....Stewart has kept his nose clean for along time as far as any law breaking....slap on the wrist is all he deserves, now lets go racing.

One of the newspaper articles, says he got them at a swap meet. I doubt he went to the swap meet, specifically looking for police lights to put on his dash, so he can pull other people over, in his big giant pickup truck. I have bought some pretty crazy stuff at swap meets myself.
